1. Representations and Warranties
Thomas Schwenke, Inc. (hereinafter "TSI") represents and warrants to the original purchaser only, and no successor in title, that any item purchased from this website is authentic and genuine as described in the written invoice which shall be provided to purchaser at the time of sale. In the event of dispute over the genuineness or authenticity of any item purchased, the liability of TSI shall be limited to refund of purchase price, and shall under no circumstances include consequential or other special damages.
2. Condition Statements
Complete written condition reports are available for any item of furniture listed on the TSI website. Condition reports may be requested by completing the online "TSI Condition Report Request Form" ("CRRF") and submitting that completed form via email to "conditionreports@schwenke.com" All information requested in our CRRF must be completed in order to receive a condition report.
3. Pricing
Items offered on this website which are owned by TSI are listed at retail prices not subject to discount except to recognized and accepted dealers, designers, architects or other trade professionals holding valid business tax resale certificates issued by the state in which their business is located, and proof of authority and copy of valid certificate will be required prior to finalizing any purchase. Items offered by TSI as broker are offered as such and (a) are not subject to discount and (b) are subject to an additional 20% buyer’s premium which will be added to the purchase price.
4. Payment
TSI accepts postal money orders, bank wire transfers, good personal and business checks, and credit cards. Please note that we
do not accept PayPal payments. TSI reserves the right to hold merchandise purchased by personal or business check until the check has cleared purchaser’s bank.
5. Shipping
All prices quoted on this website are exclusive of shipping and delivery charges, which are the responsibility of the purchaser. TSI will make arrangements for shipping of items but shipping charges are FOB Woodbury, CT and unless otherwise agreed between TSI and purchaser, the title to the goods passes to the buyer at the shipping point and if the item is somehow damaged during delivery the purchaser/owner must file the freight claim.
